East Ramapo students warned about college loan scams

SPRING VALLEY - College-bound students were warned yesterday about the perils of tuition loans and told about a recent state law protecting them from unscrupulous lenders and schools.

About 35 East Ramapo school district students attended a lecture about a nationwide investigation into college loans from a top lawyer with the New York state Attorney General's Office.

The students also were told about a state law - "Student Lending Accountability, Transparency and Enforcement Act" - that protects them and their parents from predatory loans.

The law - known as SLATE - gives students, among other rights, the ability to choose their own lending institution and polices the industry and colleges. Congress is passing a federal law mirroring SLATE to provide nationwide protections.

The investigation found that some college financial aid officers received kickbacks and other financial benefits to encourage students to take out tuition loans from specific banks and other financial institutions.

Benjamin Lawsky, deputy counselor and special assistant to the attorney general, led the investigation for Attorney General Andrew Cuomo, who took office in January. Lawsky is a former federal prosecutor and has been traveling the state, along with Cuomo, to explain the investigation and new law to students and parents.

Lawsky provided the students with lists of questions they and their parents should ask financial aid officers about tuition loans. He spoke about a "students' bill of rights."

Lawsky, for example, strongly urged students and their parents to seek federal loans with guaranteed fixed interest rates that could pay a considerable percentage, if not all, of their college tuition. He noted that private loans sometimes come with interest rates that can rise or fall.

The average yearly cost of a four-year private college is $30,367 and $13,000 for a public college. Nearly 80 percent of New York undergraduates took out tuition loans.

"All college-bound students deserve a powerful gift that provides the knowledge and the know-how needed when shopping for a college loan," Lawsky said.

After listening to Lawsky and several state and school officials, some students said they felt rather intimidated by the lengths financial institutions and some colleges would go to rip them off for profit.

"I didn't like the way they are trying to con us," said Brian Duvalsaint, 17, a Ramapo High School student. "All we are trying to do is to get into college and better ourselves."

Pedro Duarte, 17, of Ramapo High School said the system that allowed students to be ripped off was "messed up."

Duarte, Duvalsaint and other students said the information presented was extremely helpful and they would share it with other students and their parents.

Leonie Stoute, 17, of Spring Valley High School said she wants to attend St. John's University and needs a student loan. She said her brother attends college and it's a burden on her single mother.

"I thought the information was really good," Stoute said. "I know a lot of kids going to college who need this information. What's going on scares me. I am glad to have the knowledge of what's going on."

The students who attended the session were chosen to spread the word about tuition issues with their fellow students, Deputy Schools Superintendent Joseph Farmer said.

Along with Farmer and Superintendent Mitchell Schwartz, Assemblywoman Ellen Jaffee, D-Suffern, a former district teacher, and a representative of state Sen. Thomas Morahan, R-New City, attended.

Lawsky said the investigation is continuing into loan issues, as well as potential corruption involving colleges and credit card companies.

He told the students that some lenders are now falsely implying to students that they are with the federal government when trying to solicit them.

Lawsky outlined how the investigation found corruption between schools and lenders. Students were being ripped off with misleading promises that resulted in loans saddling many of them with decades of debts.

Lawsky spoke about how college loan officers illegally steered students to preferred lenders.

And he said many of those financial aid officers benefited through revenue-sharing agreements, stock options, gifts and trips from the financial institutions.

Cuomo views the tuition loan as an "educational mortgage," Lawsky said.

In a statement, Cuomo called the new state law a "valuable graduation gift" for college-bound students.

"For the class of 2008, the bill of rights combined with New York's landmark law, will ... help to keep college coasts affordable," he said.
